We continue to inform you about the news, amendments and modifications introduced in the legislation of the Republic of Moldova within February 2011.

Amendments and modifications of legislation in next fields:

Enterpreneurship
1.There have been introduced modifications and amendments in the Government's Decision No. 547 as of August 4, 1995 "on the measures coordination and regulation by the state of prices (tariffs)", which is a decision regulating prices for goods of social importance. As a result of the introduced amendments, there have been defined certain notions used in the decision's text: trade entity (distributor), processing, commercial discount, acquisition prices, price of delivery etc. As for limitation of commercial margin for social important goods both imported and inland, sold on the territory of the Republic of Moldova, it was specified that:

  • Commercial margin for imported goods sold on the territory of our country shall not exceed 20% of the acquisition price, while the cumulative commercial margin for imported goods subject to processing in commercial entities (calibration, sorting, chopping, drying, extraction, portioning, packaging, re-packaging, marking) shall not exceed 40% of acquisition price.
  • Commercial margin for inland goods sold on the territory of our country shall not exceed 20% of final price, except for bread and floury for which the commercial limit shall not exceed 10%, for building materials – 30% of final price.

Economic units practicing the trade of social-important goods, were obliged to indicate in primary documents with special regime (invoices / fiscal invoices) the acquisition/selling price of goods and size of cumulative commercial margin. (Government Decision No. 94 as of February 18, 2011, Official Monitor of the Republic of Moldova No. 32-33 as of February 25, 2011).

2. Also, pharmaceutical institutions (manufacturers, warehouses, drug-stores and their branches), in the process of their entrepreneurial activity carrying out, will take into consideration the fact that the Government introduced modifications and amendments in the Regulation on the fixation of prices for medicines and other pharmaceutical and parapharmaceutical goods, approved throught the Government Decision No. 603 as of July 2, 1997, through which there have been concretized the particularities in the formation of trade prices for medicines on the territory of our country. According to the Regulation, prices for medicines follow to be fixed as follows:

  • medicines manufactured in the Republic of Moldova will be traded for acquisition price
    (price established by manufacturers, within which, profit will not exceed 15%), with the
    application of commercial margin.
  • imported medicines shall be traded at acquisition price (price fixed by foreign
    manufacturer, which shall not exceed the manufacturer's price registered in the National
    Catalogue of prices of medicine producers), with the application of commercial margin.

Commercial margin applied on medicine trading amounts up to 40% of final price or
acquisition price, out of which:

  • up to 15% - for the companies importing and/or distributing in bulk medicines, both
    imported and inland;
  • up to 25% - for drug-stores and their branches.

When trading medicines, pharmaceutical companies are obliged to indicate in primary documents with special regime (invoice, fiscal invoice) the final price of inland medicines or acquisition price for imported medicines, size of applied commercial margin, number of series of the product, number and date of the document certifying its quality, issued by the Agency of Medicines. (Government Decision No. 63 as of February 4, 2011, Official Monitor of the Republic of Moldova No. 25-27 as of February 11, 2011).

3. Government temporarily ceased export from the Republic of Moldova of wheat classified under tariff position 1001, except for tariff position 1001 90 910 – common wheat destined to seeding. (Government Decision No. 52 as of February 2, 2011, Official Monitor of the Republic of Moldova No. 18-21a as of February 3, 2011).

4. The Ministry of Transports and Road Infrastructure modified the Temporary Instruction on the mode of issuing and book0keeping of unitary authorization for international motor traffic, approved through Order No. 11 as of January 16, 2010. The amendments refer to the conditions of issuing to licensed transportation agents of unitary authorizations: authorization type "third countries", authorization type "entry without goods" etc. (Order of the Ministry of Transports and Road Infrastructure No. 28 as of January 28, 2011, Official Monitor of the Republic of Moldova No. 25-27 as of February 11, 2011).

5. It has been approved the Regulation on the demands against assembling, exploitation and technical and metrological servicing of accounting meters with fiscal memory and carrying out of operative verification within economic entities producing ethylic alcohol, distilled and strong alcoholic drinks. The regulation stipulates requirements in assembling, exploitation, technical and metrological servicing of accounting meters with fiscal memory, installed on the equipment in the process of manufacturing of ethylic alcohol and at the bottling lines of strong alcoholic drinks; in registration, sealing/unsealing of the main technological equipment and of equipment used in the manufacturing of ethylic alcohol and distillated and strong alcoholic drinks; in the carrying out by territorial fiscal bodies of fiscal inspection, during the time of verification, through operative inspection etc. Subject to the mentioned Regulation are all economic producers of ethylic alcohol, distillated and strong alcoholic drinks producers, regardless of the legal form of organization. Operative inspection on the axis of the Regulation, shall be carried out by the State Fiscal Service, in the view of confirming the authenticity of registries data of manufacturing and circulation of ethylic alcohol, distillated and strong alcoholic drinks, for preventing and detecting the infringement of fiscal legislation, as well as sealing and unsealing of the main technological equipment. (Common order of the Ministry of Finance, Ministry of Agriculture and Food Industry and Ministry of Economy No. 172/245/216 as of December 28, 2010, Official Monitor of the Republic of Moldova No. 22-24 as of February 4, 2011).

6. In the view of ensuring safety for the goods of aquacultural goods, protection of public health and protection of consumer's right, Government approved the sanitary-veterinary Norm on the requirements against the import and placement on the market of certain aquacultural goods. (Government Decision No. 103, as of February 18, 2011, Official Monitor of the Republic of Moldova No. 32-33 as of February 25, 2011).

Tax legislation
1. In connection with the amendments and modifications introduced in Appendix No. 1 and 2 of the Government Decision No. 246 as of April 8, 2010 "on the mode of applying zero VAT share on the trade of goods, services on the country's territory and on application of fiscal and customs facilities for unleashing projects of technical and investment assistance, which are part of international treaties to which the Republic of Moldova adhered". The mentioned appendixes were published in new edition. (Government Decision No. 108 as of February 21, 2011, Official Monitor of the Republic of Moldova No. 32-33 as of February 25, 2011).

Banks and banking activity
1. The National Bank of Moldova decided to increase by 1.0 percentage points:

  • the basic rate applied on the main operations of monetary policy for short-term (8% annually);
  • interest rate for overnight credits (11% annually)
  • interest rate for overnight deposits (5% annually)

(Decision of the National Bank of Moldova No. 8 as of January 27, 2011, Official Monitor of the Republic of Moldova No. 18-21a as of February 3, 2011).

2. Also, the National Bank of Moldova decided to keep unchanged the basic rate for longterm credits (more than 5 years) at the level of 7% annually. (Decision of the National Bank of Moldova No. 9 as of January 27, 2011, Official Monitor of the Republic of Moldova No. 18-21a as of February 3, 2011).

Labour legislation
1. It has been approved the Instruction on the mode of paying and accounting registration taxes and monthly trade-unions member dues. The instruction regulates the size of registration taxes and monthly trade-unions member dues, the mode of determining monthly incomes and types of salaries, primes and other compensations, out of which monthly trade-unions member dues are paid; determination of transactions among primary trade-union organizations and national-sectorial and inter-sectorial trade-unions, bookeeping of trade-unions member dues and verification of due accumulation.
